In a twist so thick with irony it practically rewrites itself, New York Attorney General Letitia James is now invoking the very legal shield Donald Trump has been denied for years: protection from politically motivated prosecution.
On Friday, lawyers for James filed a motion to dismiss the federal mortgage fraud charges against her, claiming — with a straight face — that she’s the victim of “vindictive and selective prosecution.” The filing cites Donald Trump’s past insults and statements as evidence that her indictment is rooted in “animus” rather than evidence. In other words, the woman who campaigned on the promise to “get Trump” is now asking the court to protect her from being targeted by the president.
Let that sink in.
James’ motion opens with the claim that the case violates the Fifth Amendment, arguing that Trump’s administration is prosecuting her in retaliation for her “protected campaign speech” and “statutory duties.” This is the same Letitia James who, before setting foot in the Attorney General’s office, promised to “shine a bright light into every dark corner of [Trump’s] real estate dealings” and proudly declared, “we are not scared of you.”
Her campaign platform was, in essence, a billboard-sized declaration of war on one man — before a single investigation had begun.
Fast-forward to 2024, and James secured a civil judgment of over $350 million against Trump (now over $500 million with interest), despite no financial institutions reporting losses and every loan in question having been repaid. Even after an appeals court tossed the massive fine, the underlying fraud charge — a politically valuable talking point — remains.
Now, James faces her own legal reckoning over allegedly deceptive mortgage statements on a home purchase in Virginia. Prosecutors allege she misrepresented her income and assets to secure better loan terms — the kind of offense she turned into a statewide media circus when aimed at Trump.
And her defense? That she’s being unfairly targeted. That her political speech is protected. That the president is weaponizing the legal system to destroy her career.
The hypocrisy isn’t just staggering — it’s textbook. This is precisely the legal environment her own actions helped to legitimize: a world where political opponents can be publicly smeared, relentlessly investigated, financially crippled, and dragged through years of litigation based on selective outrage and partisan ambition.
James’ case, if it proceeds, is scheduled for trial in January. She has pled not guilty. But the implications of her motion to dismiss go far beyond one courtroom. Her legal team is essentially arguing that political prosecutions are wrong — when they happen to her.
